Terms & Conditions for PixelMorph.app

1. The Service

PixelMorph.app provides an online image resizing and enhancement tool that allows users to modify image dimensions and aspect ratios, intelligently regenerating borders without cropping, using advanced artificial intelligence technology.

2. Service Provision

PixelMorph.app is currently provided to you without requiring user accounts or maintaining user sessions. However, you acknowledge and agree that PixelMorph.app reserves the right to introduce user accounts, registration requirements, or change its method of session management at any time and without prior notice.

3. User Conduct and Prohibited Uses

You are solely responsible for all content you upload, process, and download through PixelMorph.app. You agree not to use the Service for any purpose that is unlawful, prohibited by these Terms, or prohibited by the terms of any third-party services we utilize. Specifically, you agree not to upload, transmit, or otherwise make available any content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Infringes on the intellectual property rights (including copyright, trademark, and trade secret) of any third party. You represent and warrant that you have all necessary rights, licenses, and permissions for any image or content you upload to the Service.
• Contains child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), or content depicting sexual exploitation of children.
• Promotes or depicts violence, self-harm, discrimination, hate speech, or illegal activities.
• Contains viruses, corrupted data, or any other harmful, disruptive, or destructive files or code.
• Attempts to gain unauthorized access to any part of the Service, or any systems or networks connected to it.
• Interferes with or disrupts the integrity or performance of the Service or the data contained therein.

PixelMorph.app reserves the right, but is not obligated, to monitor usage of the Service to ensure compliance with these Terms and the policies of our third-party service providers. If PixelMorph.app becomes aware of any content or activity that violates these Terms or applicable laws, it may take immediate action, including terminating the user's access to the Service without notice, blocking IP addresses, and cooperating with law enforcement authorities as legally required.

PixelMorph.app utilizes third-party services to provide its functionality, including but not limited to Cloudflare for performance, security, infrastructure management and image processing, and Stability.ai for AI-powered image resizing and regeneration.

6. Service Availability and Modifications

PixelMorph.app is currently provided to you free of charge and without advertisements. However, you acknowledge and agree that PixelMorph.app reserves the right to modify, suspend, discontinue, or otherwise change any aspect of the Service, including its availability, features, functionality, and monetization model (e.g., introducing fees for certain features, subscription plans, or displaying advertisements), at any time and without prior notice. While we strive to provide reasonable notice of significant changes, by continuing to use the Service after any such changes, you indicate your acceptance of the modified terms.

7. Rate Limiting and Service Limitations

To ensure the stability, security, and availability of our service for all users, PixelMorph.app reserves the right to implement technical measures, including rate limiting based on browser/device signatures or IP addresses, to manage the volume of requests from any single browser or device. Exceeding these limits may result in the temporary or permanent restriction of your access to PixelMorph.app. We also reserve the right to limit the maximum file size, dimensions, and other parameters for images processed through the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, PIXELMORPH.APP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF THE SERVICE OR ANY CONTENT PROCESSED THEREBY. PIXELMORPH.APP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIXELMORPH.APP, ITS OPERATORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

THIS LIMITATION OF LIABILITY INCLUDES, BUT IS NOT LIMITED TO, ANY ISSUES ARISING FROM THE PERFORMANCE OR NON-PERFORMANCE OF THIRD-PARTY SERVICES (E.G., CLOUDFLARE, STABILITY.AI) THAT PIXELMORPH.APP UTILIZES.

10. Indemnification

You agree to defend, indemnify, and hold harmless PixelMorph.app, its operators, affiliates, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms, including without limitation your breach of any of the representations or warranties herein;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
• Any claim that your content caused damage to a third party.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in England and Wales, and you hereby consent to the personal jurisdiction and venue therein.

12. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the "Effective Date" at the top of these Terms. We will make reasonable efforts to notify you of material changes, such as by posting a notice on the PixelMorph.app website. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
